Từ hàng trăm năm trước thế kỷ 20, các hoạt động và mối quan hệ trên đại dương chịu ảnh hưởng của thuyết “Tự do trên biển”, một nguyên tắc được đưa ra trong thế kỷ 17 mà theo đó, biển và đại dương được mở cho tất cả các quốc gia. Tuy nhiên, ngay trong giai đoạn đó, vẫn luôn tồn tại quan ngại về an ninh quốc gia trước những tấn công từ ngoài bằng đường biển. Để ngăn cản tàu chiến nước ngoài đi sát bờ biển quốc gia, các quốc gia ven biển bắt đầu yêu sách quyền kiểm soát đối với vùng biển gần bờ. Những yêu sách đó đã dẫn đến việc hình thành một vùng biển riêng biệt sát bờ có quy chế như đất liền – thuộc chủ quyền quốc gia – từ cuối thế kỷ XIX. Vùng biển gần bờ này – được biết đến với tên gọi “lãnh hải” và thường được mở rộng không quá 03 hải lý – ban đầu chỉ nhằm mục đích an ninh song cũng trở thành nơi khai thác tài nguyên của quốc gia ven biển.

Việc xuất hiện yêu sách về lãnh hải cũng đặt ra yêu cầu cần phải dung hoà vấn đề chủ quyền trên biển với học thuyết “Tự do trên biển” – một học thuyết chủ đạo trong việc sử dụng và khai thác biển. Đây cũng trở thành một trong những vấn đề pháp lý quốc tế được quan tâm và là chủ đề pháp điển hoá tại Hội nghị Pháp điển hoá La Hay năm 1930, được tổ chức bởi Hội quốc liên. Tuy Hội nghị này không đem đến một văn kiện pháp lý nào về biển, một số quy định, quy tắc về biển đã được sự đồng thuận giữa các quốc gia và là cơ sở cho những nỗ lực pháp điển hoá luật biển quốc tế sau đó.

Ba Hội nghị về luật biển do Liên Hợp Quốc tổ chức đã được diễn ra vào năm 1958, 1960 và từ 1973-1982. Bốn công ước về biển đã ra đời tại Geneva vào năm 1958, bao gồm: “Công ước về Lãnh hải và Vùng tiếp giáp,” “Công ước về Thềm lục địa,” “Công ước về Hải phận quốc tế,” “Công ước về Nghề cá và Bảo tồn Tài nguyên sống ở hải phận quốc tế.” Hội nghị Luật biển lần thứ ba của Liên Hợp Quốc diễn ra từ năm 1973 tới năm 1982 với sự tham gia của trên 160 quốc gia đã dẫn tới sự ra đời của Bản Hiến pháp của đại dương. Đó là bản Công ước Liên Hợp Quốc về Luật Biển (United Nations Convention on the Law of the Sea).

Bộ tư liệu được giới thiệu dưới đây là Lưu trữ của Liên Hợp Quốc, bao gồm toàn văn các bản công ước và các biên bản chính thức của Liên Hợp Quốc ghi lại quá trình xây dựng bản thảo, đàm phán và thảo luận dẫn tới sự hình thành của mỗi bản công ước. Bộ tư liệu là một nguồn tài nguyên không thể thiếu cho những nghiên cứu về sự hình thành và phát triển của Luật Biển, góp phần tìm hiểu về bối cảnh lịch sử và ý nghĩa thật sự, từ đó diễn giải được chính xác các khái niệm, điều luật trong Công ước Liên Hợp Quốc về Luật Biển.
